China Updates- development of MOFCOM on competition cases

MOFCOM continues to develop its approvals and decision making process on competition cases. On February 11th it published the final version of its "Interim Provisions on the Standards that Apply to Simplified Cases of Concentrations of Undertakings". In short, this proposes a fast-track in relativey simple anti-trust cases.

At the same time, in more complex cases, such as the Thermo Fisher Life case, decisions are being handed down at record speed, the Fisher Life decision, despite being very complex, taking only six monthes, compared with over a year of previous similar cases.

Hong Kong Updates- Employment (Amendment) Bill 2014

On 28th February, the government gazetted the Employment (Amendment) Bill 2014 which proposes three days' paid paternity leave as a statutory benefit for working fathers.

Under the proposal, (to be eligible for paternity leave) the father of a newborn, or a father-to-be, must be employed under a continuous contract and have given advance notice to his employer of his intention to take paternity leave. If he has served a minimum of 40 weeks and submitted the required documentary proof to his employer, he will also be entitled to paternity leave pay. In other words, paternity leave does not necessarily imply paternity leave pay.

The Bill will be introduced into the Legislative Council on 26th March and we will update on the final legislation.
